Lawful use of premises

The Residential Tenancies and Rooming Accommodation Act 2008 (section 184) requires all tenants to ensure that any activity conducted in their home:

  • is legal
  • does not cause a nuisance, and
  • allows neighbours to enjoy reasonable peace, comfort and privacy.

Am I allowed to run a business from my home?

If you wish to run a business from your home, you must satisfy the above three points as well as the following:

  • you must live in your home
  • your business must comply with relevant Local Government local laws and any other relevant regulations
  • the activities of the business must not cause damage to the premises
  • you must take out appropriate insurance, and
  • you must declare income from the business at your rent reviews.

The department may issue you with a Notice to Remedy Breach (RTA Form 11) if you do not satisfy these conditions (see Breaches).
