Legislative safeguards for funding

Community Services Act 2007

From 1 July 2014, new legislation applies to the investment the department makes in services delivered by non-government organisations, local governments and other entities. These changes cut red tape for funded organisations and mean that the Community Services Act 2007 is the only Act used by the department to safeguard funding.

Funding declarations

From 1 July 2014, the Community Services Act 2007  only applies to funding that is listed in a funding declaration.

A declaration can apply the Act to a funding program or to individual funding contracts.

In deciding whether to make a funding declaration, Ministers may consider several factors. These include:

  • the type of product or service being provided with the funding
  • the importance of the product or service to meeting the needs of an individual, group or community
  • the characteristics and vulnerability of users of the product or service
  • the amount of funding being provided.

Department of Communities, Child Safety and Disability Services funding declarations 2014

On 25 June 2014, the Minister for Communities, Child Safety and Disability Services, made the Department of Communities, Child Safety and Disability Services Funding Declaration 2014.

This declaration applies the Community Services Act 2007 to a stipulated range of Community Services, Child Safety, Disability and Community Care funding.

On 29 September 2014, the Minister for Communities, Child Safety and Disability Services, made the Department of Communities, Child Safety and Disability Services Funding Declaration (No.2) 2014.

This declaration applies the Community Services Act 2007 to all funding provided under the nine child, family and community services Investment Specifications approved by the Director-General on 16 September 2014.

Over time as existing Child, Family and Community Services funding agreements expire and new ones are signed, departmental investments will transition from the descriptors in the first funding declaration to those used in the new Investment Specifications. When this transition occurs, the funding will be safeguarded by the second declaration.

All declared Disability Services and Community Care funding will continue to be covered by the first declaration.

Funded organisations do not need to do anything in response to these declarations. Organisations’ service agreements with the department continue and do not need to change as a result of the declarations.
